1. Who you're contracting with
These Terms & Conditions ("Terms") form a binding agreement between you and Stackdd ("Stackdd", "we", "us"), the provider of the Stackdd service (the "Service"). By creating an account or otherwise using the Service, you agree to these Terms.
2. The Service
Stackdd provides creators with a single shareable link that hosts their content, products, and links in one place. Features available to you depend on the plan you choose.
3. Your account
You must provide accurate information when creating your account, keep your credentials confidential, and are responsible for all activity that occurs under your account. You must be of legal age to enter into this agreement, or have authority to bind the organisation you represent.
4. Acceptable use
You must not misuse the Service. In particular, you must not: (a) use the Service for any unlawful purpose; (b) engage in fraud, spam, or deceptive practices; (c) infringe anyone's intellectual property or other rights; (d) upload malware or attempt to probe, scan, scrape, or otherwise interfere with the security or integrity of the Service; or (e) resell or redistribute the Service without our written permission.
5. Intellectual property
Stackdd and its licensors retain all rights, title and interest in and to the Service, including all software, documentation and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you've selected. Content you upload remains yours; you grant us a limited licence to host and process it solely to provide the Service to you.
6. Payments, billing and subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. 7. Service availability
We work hard to keep Stackdd available, but we don't guarantee the Service will be uninterrupted, error-free, or free from delays. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
8. Suspension and termination
We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay amounts owed, pose a security or fraud risk, or repeatedly or seriously violate our policies. You may stop using the Service at any time. On termination, your right to use the Service ends; we'll give you a reasonable opportunity to export your content where practicable before deletion.
9. Liability
To the fullest extent permitted by law, our total liability to you under or in connection with these Terms is capped at the fees you paid to Paddle for the Service in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law (such as for fraud, death or personal injury caused by negligence).
10. Indemnity
You agree to indemnify Stackdd against claims arising out of your content, your unlawful use of the Service, or your breach of these Terms.
11. Changes to the Service or these Terms
We may update the Service and these Terms from time to time. Where changes are material, we'll give you reasonable notice. Your continued use of the Service after changes take effect constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the jurisdiction in which Stackdd is established. Disputes will be resolved by the courts of that jurisdiction, except where mandatory local law gives you the right to bring proceedings elsewhere.
